Sisodiya files writ petition in SC against arrest

NEW DELHI: Delhi's Deputy Chief Minister Manish Sisodiya has filed a writ petition in the Supreme Court challenging his arrest by the CBI in liquor policy scam case.

The Supreme Court agreed to hear on the matter on Tuesday on urgent mentioning by senior advocate A M Singhvi on behalf of Sisodiya.

A bench of Chief Justice D Y Chandrachud and Justice P S Narasimha initially said the petitioner can approach the High Court under Section 482 of the Criminal Procedure Code.

Singhvi, however, contended the writ petition filed under Article 32 of the Constitution was covered in the remit of the Vinod Dua case judgement.

The court also said it has entertained the other day a similar writ petition filed by Congress leader Pawan Khera as it sought clubbing of multiple FIRs.

However, on requests by Singhvi, the court agreed to hear Sisodiya's plea at 3.50 pm Tuesday itself.

Sisodiya was arrested on February 26.

Special judge M K Nagpal remanded Sisodiya to CBI custody for five days for "further and extensive interrogation".  

CBI claimed the investigation has revealed that Sisodia verbally directed the Secretary to put a new cabinet note to bring about the change and variance in the liquor policy.

He was heading the Group of Ministers constituted by the cabinet for the Excise Policy...The profit margin was enhanced from 5 per cent to 12 per cent. He could not explain why the changes were made, it alleged.
