Naidus family members threatening witnesses AP govt asks SC to cancel his bail

NEW DELHI: The Andhra Pradesh government on Monday asked the Supreme Court to cancel bail granted to former Chief Minister and TDP N Chandrababu Naidu as his family members threatened the officers who deposed against him.

"There is very serious and disturbing development," senior advocate Mukul Rohatgi claimed before a bench of Justices Bela M Trivedi and Pankaj Mithal.

He alleged the family members publicly said once their party came to power, they would take action against the officers.

The bench, for its part, asked if the allegations were on record and it would not hear anything if is not on record.

On this, Rohatgi said an application has been filed in this regard.

The bench then asked Naidu's lawyers senior advocates Harish Salve and Sidharth Luthra to file their response to the allegations.

The court posted the matter for consideration on March 19.

In his submission, Rohatgi, representing the state government contended that this is very very serious matter as the officers who participated in the investigation and made statements, have been threatened.

The family members have made public statements that they have noted the names of the officers, the counsel alleged.

Naidu's counsel Luthra contended these allegations were not part of records.

The bench also said, "We will not hear anything which is not part of record."

Rohatgi said an application has been filed in this regard.

He said the benefits of the bail cannot accrue to a party who made such a threatening statements just before the elections.

As the counsel for Naidu said they would like to file reply, the bench deferred the matter for consideration next month.

On January 16, 2024, a two-judge bench of this court had differed on the issue of obtaining prior sanction before initiating inquiry, enquiry or investigation against public servants under the Prevention of Corruption Act. The court, however, had rejected Naidu's plea to declare lodging of the FIR, his arrest and remand as illegal in the FIR registered in connection with Rs 3,300 Cr scam in setting up skill development centres.

Naidu was granted regular bail in the case in November, 2023.
